Counsel for the plaintiff along with plaintiff.
Sh. Harjinder Singh R/o 23, Block-II, Burari, Sant
Nagar is present on behalf of the defendant.
Sh. Harjinder Singh submits that he is neighbour
of the defendant and the defendant is hospitalized and is carrying
one medical file. The same is shown to the court and upon
opening the same, first page is discharge summary. Now,
Harjinder Singh submits that the defendant is not hospitalized,
but has been discharged. Now, he submits that defendant is
immobilized and is unable to walk. Despite directions, the
medical documents have not been filed. Harjinder Singh is
directed to file the copy of discharge summary of the defendant
in the court today itself.
Despite assurance, the defendant has failed to
furnish security for a sum of Rs. 20 Lacs.
On the last date of hearing, it was stated on behalf
of the defendant that as security title deeds of the property

bearing Unit No. 4, First Floor, Plot No. 05, Khasra No.21/3,
Block-A, situated in the area of village Kamalpur Majra, Burari
will be placed on record, however, no documents furnished.
Had the intention of the defendant been to furnish
security then, like medical documents have been sent through
neighbour then documents for furnishing security could have
also been sent. Satisfied that defendant is unwilling to furnish
the security, in terms of order dated 07.07.2026.
In this view, the application of the plaintiff under
Order 38 Rule 5 is formally allowed.
The property bearing Unit No. 4, First Floor, Plot
NO. 5, Khasra No.21/3, Block-A, situated in the area of village
Kamalpur Majra, Burari is hereby attached by this court. Issue
warrants of attachments, subject to filing of PF within 07 days.
Put up before Ld. ACJ for appointment of bailiff
on 16.10.2026.
It be clearly endorsed on the warrants of
attachment that, affixation of attachment be done at the address
attached, as well as notice board of the court and concerned Sub-
Registrar office and attachment be proclaimed by beating of
drums (Munadi) and statement of atleast 2 neighbours be
recorded regarding affixation proceedings.

The genesis of the order passed has been explained
in simple Hindi Language to Sh. Harjinder Singh.
The appearance entered on behalf of defendant on
07.07.2026, however, till date written statement has not been
filed. In this view, right to file written statement is hereby closed.
Re-notify for PE on 01.12.2026.
