Crl. Rev. No. 456/2026
11.08.2026
Present : Mr. Piyush Pahuja and Mr. Tushar Yadav, Ld.
Counsel for the revisionist.
Mr. Amit Dabas, Ld. Addl. PP for the
State/respondent no. 1.
Mr. Rajendra Pratap Singh, Ld. Counsel for
respondent no. 2 to 4.
R-2 (Sushma Sharma) and R-4 (Nitish Sharma) are
present.
This Court has heard Ld. Counsel for revisionist as
well as Ld. Counsel for R-2 to R-4 on the application filed by the
revisionist, seeking preponement of heraring.
The next date fixed before present Court is
25.09.2026.
Ld. Counsel for revisionist submits that on
11.07.2026, the matter was fixed for complainant’s evidence,
however, the same was not recorded at request of the revisionist.
Now, the matter is fixed before Ld. Trial Court on 22.08.2026 for
recording of evidence of complainant. Ld. Counsel submitted
that if the proceedings before Ld. Trial Court are permitted to
continue, the present criminal revision petition will become
infructuous and it is thus prayed that the revision petition may be
preponed.
Ld. Counsel for R-2 to R-4 submits that the prayer
for preponement is not even mentioned in the prayer clause of the
application and as such the application is liable to be dismissed
outrightly.
This Court has heard both the parties.

This Court finds that it is trite that in the prayer
clause, there is no request, seeking preponement of present
revision petition. Even otherwise, this Court is of the view that
there is no urgency which warrants preponement of present
revision petition as only a short date had been given by the Ld.
Predecessor Judge
vide order dated 09.07.2026, listing the
revision petition for consideration on 25.09.2026.
In view of the aforsaid, the present application is not
maintainable.
List the matter on the date already fixed
i.e. on
25.09.2026.
