Ld. Presiding Officer was on short leave
today.
Present: Sh. Deepak Kaushik, Ld. Counsel for all
the plaintiffs.
Sh. Lakshay Sharma, Ld. Counsel for
defendant no.1 alongwith defendant no.1.
Defendant no.2 is already ex-parte vide
order dated 18.09.2024.
Ms. Harsha Rani, Ld. Counsel for
defendants no.3, 5 & 34 through VC.
None for other defendants.
Ld. Counsel for plaintiff submits that Sh.
S. B. Shaily, Ld. Counsel appearing for defendants
no.8, 10 to 22, 24 to 26 and 35 to 41 has called him
and apprised that due to bereavement in the family he
is unable to come.
It is jointly reported by Ld. Counsel for
plaintiff and Ld. Counsel for defendant no.1 that one
application filed by the plaintiffs under Order XXII
Rule 4 readwith Section 151 CPC for impleading LRs
of defendant no.9 is pending disposal. It is also
reported that one application filed by the plaintiffs
under Order VI Rule 17 CPC vide which the plaintiffs
seek to make amendments in their replication is also
pending disposal.

Ld. Counsel for defendant no.1 seeks one
opportunity to file reply to the both these applications
stating that the application under Order XXII Rule 4
CPC has been filed beyond the period of limitation.
When asked as to why till date no reply
has been filed to these applications, Ld. Counsel for
defendant no.1 submits that as one after the other
application was being filed, he therefore, could not file
reply to the same.
As only defendant no.1 has sought time to
file replies to the pending applications, therefore, only
defendant no.1 is given 15 days time to file reply to
both the said applications. The right to file reply of the
other defendants, if not already filed, is hereby closed.
Put up for arguments/disposal of both
these applications on 26.11.2026.
