This is an application U/s 483 BNSS, 2023 seeking

alongwith IO SI Vipin Malik.

Counsels for applicant/accused.
Fresh reply to the bail application is filed. Copy

Ld. Counsels for the applicant/ accused submit that

submit that the applicant/accused is owner of the house and he
may apply for top up loan from the concerned bank. They further
submit that if the applicant/accused is not admitted to interim

Therefore, they request that the applicant/accused may be
admitted to interim bail for a period of one month to arrange the
aforesaid money/ fees.
Per contra, Ld. Spl. PP for the state as well as IO
have vehemently opposed the bail application stating that though
they have verified that the fees of the daughter of
applicant/accused is pending but as per the information provided
from the bank i.e. Bank of Baroda from which the

applicant/accused has already availed house loan has refused to
provide any top up loan to the applicant/accused. Therefore, they
request to dismiss the bail application.
Submissions considered. Record perused.
Admittedly, the fees of daughter of
applicant/accused is pending since 31.07.2025 who is pursuing
her MBBS and at present she is in 3rd year. Though, the
applicant/accused has not been able to tell as to from where he
would arrange the fees of Rs. 21 lakh and the concerned bank has
refused to give any top up loan to the applicant/accused but
totally on humanitarian grounds and considering the future of
daughter of applicant/accused, in the interest of justice, the
applicant/accused Vijay Bhesania is admitted to interim bail for
a period of 10 days to arrange the fees for his daughter from the
day of his release on furnishing personal bond for a sum of Rs.
50,000/- with two sureties in the like amount to following
