Order Details: COPY OF ORDER Pdf Text: 1 Interim Bail Extension Application STATE Vs. Anchit Jain FIR No. 455/24, PS Special Cell U/s 8(c)/20/21/25/27A/29 NDPS Act 05.08.2026 This is an application seeking grant of interim bail to the applicant/ accused Anchit Jain for a period of 10 days. Present: Sh. Akhand Pratap Singh, Ld. Special PP for State(through VC). Sh. Jatin Yadav, counsel for applicant/ accused(through VC). SI Vipin Malik on behalf of IO/ Insp. Nishant Dahiya in person. Reply has been filed by the IO. Arguments heard. Initially, vide order dated 25.07.2026, interim bail was granted to the applicant/ accused till 01.08.2026 on the ground of performing last rituals of the deceased grandfather of the applicant/ accused. Ld. Counsel for applicant/ accused submits that Sh. Ajay Jain, the father of the applicant/ accused, is required to proceed on a pilgrimage to Shri Sammed Shikharji, a place of pilgrimage sacred to the Jain religion, for offering prayers for the peace of the departed soul of the deceased, who will return only on 09.08.2026. Further, during the period father of the applicant/ accused remains at Shri Sammed Shikharji, an adult male members of the family has to remain present at family residence, so being the only adult male member, this obligation devolves upon the applicant/ accused. He further submits that the ensuing religious ceremonies and obligations of the deceased shall stand concluded only upon completion of 14 days reckoned from the -- 1 of 3 -- 2 date of the last rites i.e. 25.07.2026 which period expires on 09.08.2026. Ld. counsel for the applicant/ accused prays that the applicant/ accused may be granted 10 days interim bail so as to enable him to complete the aforesaid last rites and other obligatory religious ceremonies of his deceased grandfather. Per contra, Ld. Addl. PP for the state submits that the purpose for which the interim bail was granted to the applicant/ accused stands fulfilled as last rites of the deceased were already performed on 25.07.2026. The present application seeking extension of interim bail filed primarily for discharging family obligations cannot be equated with the compelling circumstances that justified the grant of interim bail. Ld. Addl. PP for the state further submits that the accused/ applicant has failed to demonstrate that his continuous physical presence at home is indispensable and he is only available adult male member is a bald assertion. Ld. Addl. PP for the state further states that accused/ applicant earlier failed to join the investigation despite directions of the Hon’ble Supreme Court observing that in this case, even all suspects should undergo custodial interrogation to unearth the international racket of drug trafficking so the allegations are grave and serious in nature and activities carried out by the drug syndicate are of gave concern. Having heard the submissions, in my considered opinion, no ground is made out to grant interim bail to the applicant/ accused, as prayed. Ld. Addl. PP for the state rightly argued that the continuation of religious obligations including the proposed pilgrimage by the father of the applicant/ accused, cannot be construed as exceptional circumstances of grief. The -- 2 of 3 -- 3 allegations levelled against the applicant/ accused pertains to operation of international drug syndicate which indeed are grave in nature. No reasonable or compelling ground for presence of the applicant/ accused at his family residence in the absence of his father when he proceeds on pilgrimage, has been demonstrated by Ld. Counsel for the applicant/ accused. Accordingly, no ground is made out to grant interim bail to the applicant/ accused for the said purpose. The present application seeking interim bail is devoid of merits and is dismissed. Copy of the order be given dasti to the learned counsel for applicant/ accused as well as IO. Another copy be sent to the concerned Jail Superintendent for information. (KULDEEP NARAYAN) Special Judge(NDPS), Central,THC, Delhi/05.08.2026 -- 3 of 3 --
