State v. Mayur Desale
PS : Special Cell
u/s 20/21/22/25/27A/29 NDPS Act
r/w Section 238/209 BNS
29.07.2025
Present: Sh. Alok Saxena, Ld. CPP for the State.
Sh. Mithlesh Jha, Sh. R.B. Chaudhary and
Sh. Nagendra Singh, Ld. Counsels for
applicant/accused Mayur Desale.
IO SI Shailesh Kumar in person.
This order of mine shall dispose off the application for
grant of regular bail to the applicant / accused Mayur Desale.
Arguments on the bail application heard and the
application and IO report and the case file perused.
Considering the contention of the applicant/accused that
he is only an employee of the company and he was working in the said
company for the last 30 days only as a chemist and therefore, he is
actually a victim and so, the applicant/accused Mayur Desale may
kindly be granted bail. On the other hand the said contention has been
rightly rebutted by Ld. CPP for the State on the ground that
applicant/accused Mayur Desale being chemist and having knowledge
of pharma was after his joining the said firm was in regular touch
with the kingpin of the International Drug Trafficking namely Rana
Tarandeep through whatsapp chat and applicant/accused Mayur
Desale was continuously reporting to the kingpin about how the
mixture attained which colour and the manufacturing of the
contraband has reached at which level and so, the applicant /accused
was having full knowledge of the fact that the contraband was being
manufactured in the said firm as he was participating in the
manufacturing of the contraband.

Keeping in view the fact that the allegations against the
applicant/accused Mayur Desale are under Section
20/21/22/25/27A/29 NDPS Act r/w Section 238/209 BNS and the
allegations are grave and serious in nature.
Keeping in view the fact that there is recovery of
518 kgs of Mephedrone from the firm in which applicant/accused
Mayur Desale was working and manufacturing the said drug. Also, in
view of the fact that the present case is a case of heavy recovery of
more than 1200 kgs of contraband and it is a case of international drug
trafficking.
Also, keeping in view the fact that case is at the stage of
arguments on charge and there is every possibility that applicant /
accused Mayur Desale would influence/threaten the witnesses or
tamper with evidence, if at liberty. So, I do not find any merit in the
present application of the applicant / accused Mayur Desale. Hence,
the present application of the applicant / accused Mayur Desale for
grant of regular bail is hereby dismissed.
Application is disposed off accordingly.
This order of mine shall not effect the merits of the case.
Copy of the order be given dasti to Ld. Counsel for
applicant / accused.
Copy of the order be sent to concerned Jail.
