This is an execution petition to execute the decree
dated 10.01.2020 passed in commercial suit no.137/2019 titled as
Alka Bist vs. JBC Publishers & Distributors & Anr.
Ld. Counsel for DH submits that the commercial
suit no.137/2019 was decreed in terms of settlement dated
08.01.2020 arrived before Delhi Mediation Centre, Tis Hazari
Courts, Delhi and parties were directed to remain bound by the
terms and conditions of settlement as well as statement made
before the court. It is submitted that an Execution Petition
no.301/2020 was filed and the JDs were directed to maintain
status quo regarding their assets, pursuant to which, the JD gave
an undertaking to make the payment and also issued 17 cheques,
which were dishonoured on presentation.
Ld. Counsel for DH further submits that the JD
transferred the substantial amount from her account into the
account of her husband, accountant and other relatives as a part
of strategy in violation of the undertaking, who have been
arrayed as respondents in the present execution petition.
Heard. Issue notice of the execution petition to the
JDs/respondents on filing of PF, Speed post as well as through
approved courier for next date of hearing. Steps be taken within a
week.

court.
