Plaintiff has filed an application u/s 11 Rule 1 of
Commercial Courts Act r/w Section 151 CPC alongwith
documents i.e. GST returns and part payments made by the
defendant through bank transaction.
Arguments heard.
Ld. Counsel for plaintiff submits that earlier plaintiff
has filed GST return annexure-3A but same was not complete,
therefore, now plaintiff wants to file complete GST return. She
further submits that plaintiff also wants to file bank statement to
show that defendant has made part payments in plaintiff’s bank,
which is situated within the jurisdiction of this Court. She also
submits that case is at initial stage and no prejudice would be
caused to the defendant, if the application is allowed.
I have heard submissions and gone through record.
In view of submissions, I allow the application and
take additional documents on record.
Let summons of the suit be issued to defendant on
filing of PF / RC-AD as well as all other modes for 23.09.2024.
Steps be taken within a week.
