Defendant no. 1 has not filed WS. Ld counsel for
defendant no. 1 submits that he shall file WS and reply to application
under Order 39 Rule 1 and 2 CPC during the course of the day. Be
so filed with an advance copy to the opposite side against
acknowledgment.
Despite opportunity, defendants have not filed reply to
application under Order 39 Rule 1 and 2 CPC. Time sought. Granted.
Let the same be filed within a period of one week from today with an
advance copy to the opposite side against acknowledgment, failing
which, a cost of Rs. 3000/- shall be imposed on defendants.
Plaintiff seeks an adjournment on account of
bereavement in the family of main counsel. Granted.
This matter pertains to Sr. Citizen. Ahlmad is directed to
make noting on title page in this regard.
At request, re-list for arguments on application under
Order 39 Rule 1 and 2 CPC on 16.02.2026. Date is given as per
