The accused, namely, Javed Malik @ Jaidev @ Sunny @ Pouva has not been produced from judicial custody. Concerned IO SI (Retd.)Narender Pal is present. PW HC Amit and PW HC Naveen are present. PW W /HC Poonam and PW HC Momin Khan are not present. The SHO is not present despite execution of bailable warrants. Notably, even on the last date of hearing, the SHO was neither present nor any steps taken regarding the FSL report despite repeated directions. Needless to mention, no reasons for absence even today is forthcoming. Accordingly, a copy of this order be marked to the concerned Joint Commissioner to look into the conduct of SHO Insp. Neeraj Kumar Sharma and to take necessary steps at his end. At this stage, Ld. Addl. PP for the State has apprised this Court that SI Pritam Singh, Depute IO is in the process of filing supplementary charge-sheet regarding the FSL report and sanction in terms of Section 39 of the Arms Act. Let the same be done as prayed for. The matter is passed over as accused has not been produced from judicial custody. Neeraj has entered appearance and submitted that due to inadvertence he could not appear during the earlier call. However, the SHO has submitted that the FSL report and sanction order would be filed as a supplementary charge-sheet. The SHO has further submitted that he would be careful in future. Accordingly, in view of the same, directions for marking the order to the concerned Joint Commissioner are hereby recalled. SHO Insp. Neeraj is warned to be careful in future. PW-4 HC Naveen has been examined, cross-examined and discharged. PW HC Amit is present. However, he is discharged unexamined at the request of Ld. Counsel for the accused.
