Order Details: COPY OF JUDICIAL PROCEEDINGS
Pdf Text: SC No. : 452/2024
FIR No. : 175/2023
State v.Rohit @ Tulla
PS : Timarpur
u/s : 308/34 IPC
30.05.2025
Present: Sh. Alok Saxena, Ld. CPP for State.
Sh. V.K. Dwivedi alongwith Sh. Ashok Mishra, Sh.
Santosh Pandey and Ms. Anjali Tiwari, Ld. Counsel
for applicant/accused Rohit @ Tulla.
IO SI Ashok Kumar in person.
This order of mine shall dispose off the application
for grant of regular bail to the applicant / accused Rohit @ Tulla.
Arguments on the bail application heard and the
application and IO report and the case file perused.
Keeping in view the fact that the allegations against
the applicant / accused Rohit @ Tulla are that applicant/accused
alongwith co-accused persons has caused knife injury upon the
complainant due to which he is still unable to walk properly as
per version of IO. Thus, the allegations against the
applicant/accused are under Section 308/34 IPC and the
allegations are grave and serious in nature.
Ld. Counsel for the applicant/accused Rohit @ Tulla
contended that ground of arrest has not been separately given to
the applicant/accused Rohit @ Tulla and therefore, the
applicant/accused may kindly be granted bail. But, this
contention has been rightly rebutted by Ld. CPP for the State on
the ground that reason of arrest has been duly given on the arrest
memo to the accused and so, there is no violation of any

condition of arrest.
Keeping in view the fact that the case is at the stage of
charge and there is every likelihood that applicant / accused
Rohit @ Tulla would influence/threaten the witnesses, if at
liberty. So, I do not find any merit in the present application of
the applicant / accused Rohit @ Tulla. Hence, the present
application of the applicant / accused Rohit @ Tulla for grant of
regular bail is hereby dismissed.
Application is disposed off accordingly.
This order of mine shall not effect the merits of the
case.
Copy of the order be given dasti to Ld. Counsel for
applicant / accused.
Copy of the order be sent to concerned Jail.
