At 4:00 pm.
This order shall dispose of an application of bail
filed on behalf of accused/applicant Ansh Khempal. The bail
application is contested by the prosecution.
Ld. Counsel for the accused submitted that he has
been falsely implicated; he is in custody since 15.12.2023;
nothing has been recovered from him; most of the offences
alleged against him are bailable; there is delay of one day in
registration of the FIR; the accused was arrested after nine
months of the commission of the offence; he is the sole bread
earner of his family; his mother is a widow who works as a
security guard; he has one unmarried sister to lookafter. Hence,
he be granted bail.
Ld. CPP for the State, on the other hand, submitted

that the allegations against the accused are grave in nature and no
ground for grant of bail is made out.
I have considered the rival submissions and have
gone through the case file.
The present FIR was registered on the complaint of
complainant Sumit who stated that on 06.03.2023 at about 7:00
p.m., accused/applicant Ansh Khempal alongwith his friend
Tarun and 2-3 other persons came to him and stated that they will
teach him a lesson for having fought with them on the night of
Shiv Ratri. Thereafter, they all started beating him. Accused
Tarun caught hold of his hands whereas accused Khempal
assaulted him with a knife in his back. Complainant Sumit was
found to have sustained grievous injuries.
Vide order dated 09.07.2024, Ld. MM-02, Central,
Delhi observed that the complainant was assaulted by the
accused persons with a specific motive and they had come with a
common intention armed with a deadly weapon to achieve the
desired result. The complainant remained under treatment for two
months. Finding a prima facie case u/s 308 IPC, the case was
committed to the Court of Sessions. Finding a prima facie case,
charge for commission of offence u/s 308/341/506/34 IPC was
framed against the accused on 10.03.2026.
The accused has been specifically named by the
complainant in the FIR. The complainant and other witnesses are
yet to be examined. Considering the nature and gravity of the
offence, the possibility of accused influencing the witnesses or

flee from justice cannot be ruled out. In these circumstance, I do
not considered it to be a fit case for grant of bail. Hence, the
present application of the applicant /accused for grant of regular
bail is hereby dismissed.
Copy of the order be given dasti to Ld. Counsel for
applicant / accused.
Copy of the order be sent to concerned Jail.
