Order Details: COPY OF JUDICIAL PROCEEDINGS Pdf Text: 19 CS DJ 686/24 Prakash Kaur Vs. Avtar Singh 10.03.2026 Present: Sh. Sumit Gaba, Ld. counsel for the plaintiff alongwith plaintiff. Sh. Naval Kishore, Ld. Counsel for defendant alongwith defendant. A perusal of the record reveals that the matter is presently pending for addressing further arguments on the application filed by the plaintiff under Order XV-A CPC (Delhi Amendment). It is further noticed that in the ordersheet dated 24.11.2025, the said application has inadvertently been recorded as an application under Order VIII Rule 10 CPC. However, from the record and the nature of the application filed by the plaintiff, it is clear that the application is in fact under Order XV-A CPC (Delhi Amendment). Accordingly, the ordersheet dated 24.11.2025 is corrected to the said extent, and the reference to Order VIII Rule 10 CPC therein shall be read as a reference to Order XV-A CPC (Delhi Amendment). The necessary endorsement to this effect be made at the foot of the ordersheet dated 24.11.2025 so as to reflect the correct provision under which the application has been moved. It further transpires from the record that when the said application was partly heard and was pending consideration, the matter was, with the consent of the parties, referred to mediation vide order dated 24.11.2025 with a view to explore the possibility of an amicable settlement between the parties. -- 1 of 2 -- At this stage, learned counsel for the parties jointly submit that the dispute could not be resolved during the mediation proceedings. However, they submit that the parties are still engaged in discussions and negotiations with a view to arrive at an amicable settlement outside the Court, and therefore seek some further time for exploring the possibility of an out-of-court settlement. Considering the joint request made on behalf of the parties and bearing in mind that settlement of disputes through mutual agreement is always desirable as it saves valuable judicial time and preserves the relationship between the parties, this Court is inclined to grant a short accommodation to enable the parties to explore the possibility of resolving the dispute amicably. Accordingly, the matter is adjourned to enable the parties to explore the possibility of an out-of-court settlement. It is, however, made clear that in the event the parties fail to arrive at a settlement, the matter shall be taken up for addressing further arguments on the plaintiff’s application under Order XV-A CPC (Delhi Amendment) on the next date of hearing i.e., 30.03.2026. (NEERAJ SHARMA) District Judge-04, Central Tis Hazari Courts, Delhi 10.03.2026 -- 2 of 2 --
