Present: Sh. Anupam Jindal, Advocate for Decree Holder.
Ld. Counsel for the Decree Holder has filed an
application under Section 39 CPC read with Section 151 CPC
for issuance of the Transfer Certificate. It is submitted that the
Judgment Debtor is having the property at Morpheus Pratiksha,
GH16A, Sector1, Greater Noida, West201306, Uttar
Pradesh and also at A22, Sector51, Noida201301, Uttar
Pradesh and there is no movable and immovable property of
the Judgment Debtor in Delhi which can be attached to
satisfy the decree in the present case. It is therefore, prayed that
the present execution petition may be transferred to the
competent court at Surajpur, Noida, Uttar Pradesh.
I have considered the submissions made. Since the
Judgment Debtor has no movable and immovable property in
Delhi which can be attached to satisfy the decree in the present
case, hence Transfer Certificate be issued to the Decree Holder
with request to the concerned Ld. District Judge, Surajpur,
Noida, Uttar Pradesh, for execution of the decree, as per law.
One copy of the transfer certificate be given dasti to
the Decree Holder.
File be consigned to Record Room.
