Present: Sh. Vaibhav Jain-Ld. counsel for the plaintiff.
Ld. counsel for the plaintiff submits that he is filing
some documents with list of documents.
Heard. File perused.
Vide my separate order announced in the open
Court, an application under Section 12-A of the Commercial
Courts Act, 2015 moved on behalf of the plaintiff seeking
exemption from institution of pre-litigation mediation is disposed
of.
Issue summons for settlement of issues and notice of
the application under Order XXXIX Rule 1 and 2 CPC to
defendant on filing of PF, speed post and approved courier
returnable for the next date of hearing.
Process should state that the Written Statement has
to be filed within 30 days (extendable up to 120 days with the
leave of the Court and subject to terms) from the date of service
of process as per amended CPC (as applicable to Commercial
Courts).
Steps be taken within 07 days from today.
Be put up on 18.07.2026.
