Ms Shiwani Tripathi Ld Counsel on behalf of Bank of Baroda.
Ms Shiwani Tripathi has appeared on behalf of Bank Manager, Bank
of Baroda, Asif Ali Road, Delhi. She has placed on record the bank account
statements of the bank account of the JD’s i.e Mohd Ali & Sh Manoj Kumar. As per
the said statement there is a credit balance of Rs 1,00,673.70/- in the bank account
of Sh Md Ali and Sh Manoj Kumar.
Issue warrants of attachment for an amount of Rs 1,00,000/- against
the bank account of Sh Md Ali bearing no 00930100017864 maintained with Bank
of Baroda, Asif Ali Road, Delhi on filing of PF. The bank manager is directed to
forward the attached account by way of bankers cheque/demand draft drawn in the
name of the DH i.e. Sh Moinuddin.
JD no 1 i.e. Sh Md Ali has also handed over an amount of Rs 1 Lakh in
cash to the DH in the court today. A further amount of Rs 50,000/- in cash has been
handed over to the DH by Sh Manoj Kumar i.e. JD no 2. Same is acceptable to the
DH.
The JD’s are granted one months time to comply with the mediation
settlement agreement and in case the balance amount is not paid within the said
period of time, let JD no 1 i.e. Md Ali remain present in the court who is directed to
show cause as to why a false statement and undertaking was made to the court.

The JD’s are also directed to file their respective affidavits disclosing
the asset owned and possessed by them on the NDOH.
