Present: Sh Absar Ahmed Ld Counsel for DH.
Ld Counsel for the DH has filed on record the copy of the cheques
alongwith their return memos and also copy of the legal notice dt 19.03.2025 alongwith
its reply. Same are taken on record.
Keeping in view the fact that under the mediation settlement agreement dt
19.12.2024 JDs no 1 & 2 who were defendant no 1 & 2 in the suit bearing no 1098/23,
had handed over 2 cheques for a total sum of Rs 14 lakhs which have been returned
dishonoured despite assurance that the cheques as handed over would be encashed on
their presentation and had suffered a consent decree dt 10.03.2025 the present petition
being within a period of 2 years, issue warrants of attachment for an amount of Rs
14,00,000/- against the bank account of the JD no 1 bearing no 00930100018038, Bank
of Baroda, Asif Ali Road, Delhi-02, and also in respect of bank account of JD no 2
bearing no 00930100017864 maintained with Bank of Baroda, Asif Ali Road, Delhi-02
on filing of PF.
It is made clear to the concerned Bank Manager that the Warrants of
attachment are for a total amount of Rs 14 lakhs and in case there is sufficient balance to
honour the warrants of attachment issued by the court for an amount of Rs 14 lakhs,
Warrants of attachment be not executed in respect of other account i.e. of JD no 2.
List on 04.08.2025. Copy of this order be sent alongwith the Warrants of
attachment.
