It is submitted on behalf of JD No.1 that he has gone to Bijnore for
performing. As per the reports upon the NBW submitted to the Court on
20.12.2025, it has been stated that JD No.1 had gone to Lucknow.
As per the DH, as on today Rs. 9,80,000/-, payable by the JDs under
the consent decree dated 10.01.2025. The settled amount which was handed over
by way of two cheques as issued by JD No.1 dated 10.01.2025 for an amount of Rs.
6,00,000/- and cheque dated 22.02.2025 issued for a sum of Rs. 8,00,000/- stood
dishonoured. The JD No.1 has thereafter absconded and the NBWs have
accordingly not been executed against JD No.1. It is submitted on behalf of JD
No.1 that the balance outstanding amount under the consent decree i.e. an amount
of Rs 10,80,000/- would be paid within one week from today.
The DH is directed to deposit the subsistence allowance with respect to
JD No.1 within 02 days from today and upon deposit of the same, keeping in view
the fact that JD no.1 has absconded, issue fresh NBW against JD No.1 on filing of
PF, to be executed through concerned SHO by the the NDOH. The concerned SHO,
is directed only to release the aforesaid JD upon the tender of balance decreetal
amount of Rs. 10,80,000/- from custody and, in case of non-payment of the said
amount, he is directed to produce the JD No.1 with all convenient speed before the
Court.
The JD No.2 as recorded vide order dated 16.12.2025 had undertaken
to pay a further amount of Rs. 5,30,000/- on or before 15.01.2026 has not appeared
before the court and instead Sh. Rudraksh Mathur, Proxy Counsel for the LAC

Counsel has entered appearance and he submits that the JD would be present by
2.00 PM since he has gone to attend cremation. Let the amount undertaken to be
paid by JD No.2 be brought / deposited in the Court at 2.00 PM for which a pass
over has been sought.

JD No.2 is directed to appear physically in person on NDOH.
