Present: Sh. Kapil Kumar , Ld. Counsel for the petitioner.
Matter was listed for verifying of the address of the
insurance company. Ld. Counsel for the petitioner has filed
amended memo of parties along with an application under Order
1 Rule 10 CPC. It is submitted that the correct and updated
address of the insurance company is mentioned in the amended
memo. Further, vide the application under Order 1 Rule 10 CPC,
the Nodal Officer of the insurance company is sought to be
impleaded as a respondent.
Heard. Perused. Application is allowed.
Amended memo of parties taken on record.
Certified copies of the criminal record is already on
record. However, the copy of the insurance policy is not legible.
Further, the identity card of the deceased is not on record. Ld.
Counsel submits that he shall place on record the said documents
on the NDOH. Allowed.
Further, perusal of the record shows that the date of
accident is 24.12.2025 but the file was received on 17.07.2026,
which is beyond the limitation period of six months. Ld. Counsel
for the petitioner submits that the file was physically received by
this court on 17.07.2026 but the same was already efiled on
19.05.2026 i.e. within the limitation period.

Ld. Counsel has also already placed on record the
document qua the efiling. Perused. In view of the same, the
matter is within limitation.
