PW-1 examined, cross-examined and discharged.
PW-1 is directed to disclose her complete bank account details on
affidavit.
It is stated by the ld. Counsel for the plaintiff that he
does not want to file any reply to the applications of the
defendant filed under Section 45 read with 73 of the Indian
Evidence Act and application seeking interrogatories under Order
XI rule 2 and 14 CPC. In view of the same arguments heard.
Through application filed under Order XI rule 2 and
14 CPC, the defendant is seeking disclosure of bank account of
deceased Rajender Prasad Gupta, pass-book, cheque book,
acknowledgement card containing original signatures of
Rajender Prasad Gupta to be compared with his signatures on
the MOU relied by the defendant.
For the plaintiff, it is stated that no such document is
in power and possession of the plaintiff. Since the plaintiff has
denied having any document containing the original signatures of
Sh. Rajender Prasad Gupta, the plaintiff is directed to give on
affidavit bank account details of Sh. Rajender Prasad Gupta to
enable the defendant to summon that record, if any available,
bearing original signatures of Sh. Rajender Prasad Gupta. This
application stands disposed of.

The other application of the defendant shall be
considered only after receiving documents containing original
signatures of Sh. Rajender Prasad Gupta.
