File taken up today on an application.
Present: Sh Anil Garg Ld counsel for the plaintiff a/w Sh Ankit Verma.
An application has been filed on behalf of the plaintiff to withdrawal the
present suit under the provisions of Order 23 Rule 1 CPC contended that the plaintiff
has amicably settled all the disputes and differences with the defendants with respect
to subject matter of the present suit vide memorandum of settlement dt 16.07.2026.
Perusal of the settlement agreement which has been executed out of the court goes to
show that the same has been executed on behalf of the plaintiff by Ms Seema Verma
and Sh Ankit Verma. As per the full and final settlement agreement dt 16.07.2026, the
defendant has to pay an amount of Rs 50 lakhs to Ms Seema Verma on or before
31.07.2026 and upon realization of the said amount, Ms Seema Verma and Sh Ankit
Verma would withdraw all litigations including the present suit.
Keeping in view the fact that the plaintiff himself has filed the present
application duly supported with the vakalatnama of Director of the plaintiff, the
present application is allowed and the plaintiff upon the receipt of full and final
settlement recorded vide settlement agreement dt 16.07.2026 is permitted to
withdraw the present suit.
Separate statement of plaintiff Sh Ankit Verma has been recorded in this
regard. He is bound by the statement. It is submitted by Ld counsel for the plaintiff
on instructions that the entire settled amount of Rs 50 lakhs stands received by Ms
Seema Verma.
Since the present case has been settled out of the Court therefore the
plaintiffs are entitled to refund of the 50% Court fees in view of the judgment passed
by Hon’ble Supreme Court of India in the case of The HC of Judication at Madras
vs MC Subramaniam & Ors SLP (Civil) No 3063-3064/2021, DOD 17.02.2021.

Ahlmad is directed to prepare the certificate of refund of the 50% Court
Fees.
In view of the same, the present matter is dismissed as withdrawn as
settled.
Earlier date i.e. 10.09.2026 stands cancelled.
File be consigned to record room after due compliance.
