Counsel for the petitioner through VC. IO/HC Sunil Kumar, PP Dulina, Sadar Jhajjhar in person. The IO has appeared in pursuance to the notice issued to him. He has filed on record the copy of the DD no.13 dated 16.11.2024. It is submitted that as per the inquiry, the accident was not caused by the rash and negligent act of any vehicle but the injured had himself fallen. Ld. Counsel for the petitioner submits that the petitioner was traveling in a vehicle behind the offending vehicle. The driver of the offending vehicle stopped the vehicle suddenly due to which the vehicle behind him hit the offending vehicle, due to which the petitioner sustained injuries. It is submitted by Ld. Counsel that the petitioner shall prove the rash and negligent act of the respondent no. 1 during trial and summons may be issued. Heard. Allowed. In the present matter the accident was caused on 14.11.2024 but the petition has been filed on 09.06.2025 i.e. after 6 months of the cause of action. Hence, as per the newly amended MV Act, the present petition is barred by limitation. Contd.../- -- 1 of 2 -- -2- Ld.
