Fresh vakalatnama filed on behalf of plaintiff. Be taken on
record.
Application filed for waiver of cost on the ground that
plaintiff was unwell and copy of medical prescription filed which is
pertaining to 16.02.2026.
The same is opposed on behalf of defendant being a
delaying tactics and that for last many dates, the plaintiff was not
appearing for recording the evidence.
The matter was fixed for PE and is reflected in the order
dated 25.04.2025. Repeatedly adjournments have been sought by the
plaintiff and no justification has been give for prior adjournment. The
application is dismissed and disposed of.
It is submitted that file of Ld. Counsel for plaintiff was
misplaced and therefore adjournment is sought and certified copy has
been applied.
The same is opposed and it is submitted that why should the
defendant suffered due to this lapse on the part of plaintiff.
Another opportunity is given, subject to cost of Rs.4000/-
(total) to be given to Ld. Counsel for defendant.
