Sh. Vinod Kumar Verma, Ld. Counsel for the
defendant alongwith defendant through VC.
At this stage, Ld. Counsel for the defendant submits
that he has moved the present application for recalling/setting
aside of order dated 01.06.2026 by which the defendant has been
directed to appear before Ld. Local Commissioner for evidence
on preliminary issue. He further submits that the fees prescribed
for recording of evidence by Ld. Local Commissioner is fixed at
Rs. 15,000/-, which is on higher side and defendant is not
capable to afford the fees of Ld. Local Commissioner. Heard.
Since the defendant has engaged a private counsel of
her own choice and the defendant has been paying his fees and
also bearing the expenses of daily needs, which shows her
financial capability, hence, there is no ground for recalling the
said order. Therefore, the present application is without any merit
and same is disposed off as dismissed.
Defendant is directed to approach the Ld. Local
Commissioner for concluding her evidence in terms of order
dated 01.06.2026.
Matter is adjourned.
