It is submitted by ld. counsel for DH that he does not want to
file any reply to the application of the JD for waiver of the cost but opposes
the same.
Arguments heard on the application. Record perused.
It is submitted by ld. counsel for JD that there was death of his
mother-in-law and on that account he was out of station and was coming
back to Delhi through train on 15.09.2025, which reached Delhi at about 2
pm and hence, he could not appear when the case was called. It is
submitted by ld. counsel for DH that no such facts have been stated in the
entire application. Under the facts and circumstances of the case, the
application is allowed. The costs imposed vide order dated 15.09.2025 on
the JD are waived.

One copy of the order dated 19.12.2023 placed on record by ld.
counsel for DH.
