Reply to application under Order 11 Rule 1(5) r/w
Section 151 of the plaintiff along with affidavit, admission-denial
affidavit and copy of email for service of the application has been
filed on behalf of defendant no.1.
An application under Order 6 Rule 17 r/w Order 1 Rule
10 CPC for amendment in the memo of the parties providing correct
address of the defendant no.2 filed on behalf of the plaintiff.
It is stated that the plaintiff has recently got to know the
correct address of the defendant no.2.
The application opposed by Learned Sh. Jain submitting
that the defects in the plaint would not be cured even if the application
is allowed and that the false claims have been made in the plaint
including in para nos. 12 and 13.
Arguments heard.
Considering that the fresh particulars of the defendant
no.2 has come to the notice of the plaintiff.
The application is allowed.
Amended memo of the parties is taken on record.
Adjournment has been sought on behalf of Learned
Counsel for plaintiff as main counsel is busy in Hon’ble High Court of
Delhi.
Heard. Allowed.
At request, put up for arguments on the application
under Order 11 Rule 1(5) read with Section 151 CPC on 18.11.2024.
