Present : None.
Record perused for the disposal of the application filed by the
JD for de-freezing his bank account (salary account no. 90682010118451)
in Canara Bank, MAMC Branch, Bahadur Shah Zafar Marg, New
Delhi-110002. I have already heard counsels for the parties on the
application.
It is the contention of the JD in the application and was also
contended orally by the Ld Counsel for JD that in compliance of Order
dated 29.07.2025 whereby warrants of attachment against bank account and
salary account of the JD were directed to be issued, the bank has freezed the
bank account causing great hardship to the JD. On account of freezing of
the bank account, the JD is unable to pay the monthly school fees of the
children. It was also contended by the Ld Counsel for JD that money is also
required for the treatment of the JD.
The application was opposed by Ld Counsel for DH on the
ground that JD did not even file any appeal against the Judgment and
Decree sought to be executed and hence, the said decree has become final.
Even after attachment of the bank account, more than three lakhs of
decreetal amount is yet to be paid by the JD. She sought dismissal of the
application.
The amount on attachment of the bank account has already
been received. The salary account has been attached to the maximum extent
permissible legally. Under the facts and circumstances of the case, the

concerned bank of the JD is directed to de-freeze the account except to the
extent of the salary attached and if not required by any other Court Order.
Application is disposed of accordingly.
