PRESENT: Sh Udit Sharma, Ld counsel for plaintiff.
Sh Ashwani Kumar Mishra, Ld counsel for
defendant through VC.
On behalf of plaintiff, it is submitted that no
documents is filed by the defendant along with WS and therefore,
there is no occation for plaintiff to file an affidavit regarding
admission/denial of documents. Ld counsel for defendant who is
appearing through VC submits that they have already filed an
affidavit qua admission/denial of documents. Ld counsel for
plaintiff submits that copy of the same has not been supplied to
them till date, if so filed by the defendant.
Heard. Record perused.
Perusal of order sheets does not reflect that if any
affidavit qua admission/denial of documents is filed on behalf of
defendant rather order sheet dated 03.02.026 mentions that Ld
counsel for defendant had sought time to file affidavit qua
admission/denial of documents.
No further opportunity is required to be given for
this purpose.
Pleadings are complete and on the basis of
pleadings/material, following issues are framed.
1. Whether the plaintiff is entitled to decree of Rs.
15,00,000/-? OPP.
2. Whether the plaintiff is entitled to any
Pendentelite and future interest? if so, at what
rate? OPP.

3. Whether the plaintiff is entitled to recovery of
Rs. 10,00,000/- from interior expenses and any
interest on said amount, if so, at what rate? OPP.
4. Whether the plaintiff is entitled to any damages,
if so, how much damages/compensation? OPP.
5. Whether the plaintiff is entitled for any interest
on the damages & compensation, if granted, if
so, at what rate and for what period? OPP.
6. Whether the suit is bad for misjoinder of parties?
OPD.
7. Whether the suit has been filed without any
cause of action?OPD.
8. Relief.
No other issues arises or pressed for. Let affidavit in
lieu of PE be filed with advance copy to opposite party.
Subject to filing and supplying the same, put up the
matter for tendering cross examination of PW-1, on 24.11.2026.
