Order Details: COPY OF JUDICIAL PROCEEDINGS Pdf Text: SC No. : 317/2023 FIR No. : 285/2022 State. v. Kamal Singh @ Langda PS : Gulabi Bagh u/s : 328/379/34 IPC 05.08.2025 Present: Sh. Alok Saxena, Ld. CPP for the State. Sh.Deepanshu Goswami, Ld. Counsel for applicant/accused Kamal Singh @ Langda. IO not present. This order of mine shall dispose off the application for grant of regular bail to the applicant / accused Kamal Singh @ Langda. Arguments on the bail application heard and the application and IO report and the case file perused. Considering the contention of applicant/accused that the scooty recovered is bearing no. 3964 while the scooty which belongs to the applicant/accused is bearing no. 3962. Also, the applicant/accused contended that the site plan of the recovery of said scooty has not been prepared by the IO and all these facts shows that applicant/accused Kamal Singh @ Langda has been falsely implicated and therefore, applicant/accused may kindly be granted bail. But, this contention has been rightly rebutted by Ld. CPP for the State on the ground that whether it is a case of typographical error or any irregularity but the same should be considered at the merits of the case and not at the stage of bail. Ld. CPP for the State also contended that there are grave allegations against the applicant/accused Kamal Singh @ Langda because applicant/accused was not only the owner of the said -- 1 of 3 -- -2- scooty recovered but also, the said scooty contained the stupefying substance which was used in the present case upon the victim and therefore, applicant/accused is not entitled to bail. Keeping in view the fact that grounds of parity is not made out in favour of applicant/accused Kamal Singh @ Langda to that of co-accused Gaurav @ Haddi as the allegations against applicant/accused Kamal are that the stupefying substance which was given to the complainant was recovered from his scooty. Also, as per IO report, in the CCTV footage, applicant/accused Kamal Singh @ Langda was clearly seen alongwith other co- accused near the place where the loaded rickshaw of complainant was stolen. Also, the CDR of the mobile number used by applicant/accused Kamal Singh Langda was near the spot of incident and he was in regular touch with the co-accused. Thus, the allegations against the applicant/accused Kamal Singh @ Langda are u/s 328/379/34 IPCand the allegations are grave and serious in nature. Keeping in view the fact that the case is at the initial stage i.e. at the stage of charge and there is every likelihood that applicant / accused Kamal Singh @ Langda would influence/threaten the witnesses or would tamper with evidence, if at liberty. Also, applicant/accused is a habitual offender as he is previously involved in many criminal cases of similar nature. So, I do not find any merit in the present application of the applicant / accused Kamal Singh @ Langda. Hence, the present application of the applicant / accused Kamal Singh @ Langda for -- 2 of 3 -- -3- grant of regular bail is hereby dismissed. Application is disposed off accordingly. This order of mine shall not effect the merits of the case. Copy of the order be given dasti to Ld. Counsel for applicant / accused. Copy of the order be sent to concerned Jail.
