seeking grant of regular bail to the applicant/ accused Mohd.
Jameel.

Arguments heard on the bail application of the
applicant/ accused.
Ld. counsel for applicant/ accused submits that the
applicant/ accused has been falsely implicated in this case. He
further submits that the police had earlier information regarding
the present offence, further place of incident is a hotel and there
were several persons including the owner of the hotel and its staff
but police has failed to join any independent witness while
alleged recovery was made from the accused/ applicant. He
further submits that there are CCTV cameras in the hotel but
police has failed to secure any CCTV footage of the incident.
He further argues that the police has not
photographed or videographed the incident of alleged recovery
from the applicant/ accused. He further argues that the grounds of
arrest allegedly supplied to the applicant/ accused have not been
signed by the applicant/ accused, therefore, according to him, no
grounds of arrest was given to the applicant/ accused. He has

relied upon the judgment of the Hon’ble Supreme Court of India
titled as
Vihaan Kumar Vs. State of Haryana & Anr., Arising out
of Special Leave Petition (Crl.) No. 13320/2024, decided on
07.02.2025. He requests to admit the accused/ applicant on bail.
At this state, Ld. proxy counsel for Ld. Special PP
Sh. Ranbir Singh Kundu seeks a pass-over for 11:30 AM.
