Oral request for exemption is made by / on behalf of the appellant on the ground of some personal difficulty. Notably, no application in this regard is forthcoming. Nevertheless, in the interest of justice and for the reasons so stated, the exemption from personal appearance is allowed for today only. At this stage, request for adjournment is made by Ld. Counsel for the appellant on the ground that he has been newly engaged in the present case. Same is vehemently opposed by Ld. Counsel for the respondent no. 1 on the ground that the appellant is deliberately delaying adjudication in the present case. In view of the above and in the interest of justice, list for further proceedings on 23.10.2026, subject to the appellant paying a sum of Rs.1000/- to the respondent on the next date of hearing.
