Reply filed on behalf of respondents No. 1, 3, 4, 5 &
6 alongwith an application for condonation of delay and
statement of truth. Copies supplied.
Scanned copy of reply filed on behalf of respondent
no.2 alongwith statement of truth and an application for
condonation of delay also filed. It is stated that the original reply
is in transit from Arunachal Pradesh where the project in question
is going on and that the same shall be filed within one week from
today.
Counsel for petitioner states that as he is pressing for
urgent relief he has no objection if scanned copy is placed on
record and respondent no.2 is permitted to file original reply and
application within one week from today as prayed for.
In view of the submissions, Scanned copy of reply
and application for condonation of delay, filed on behalf of
respondent no.2, are taken on record and respondent no.2 is
permitted to file original thereof within one week from today as
prayed for.

During the course of arguments, talks of settlement
have taken place between petitioner and respondent no.1
whereby respondent no.1 has agreed to pay a sum of
Rs.1,23,32,987/- to petitioner in four installments within period
of 120 days. The petitioner has accepted the offer of respondent
no.1 without prejudice to its right to claim interest for delay
payment of the said amount during the course of arbitration
proceedings.
The counsel for respondent no.1 prays for
adjournment to file affidavit of AR of respondent no.1 alongwith
four PDCs of agreed installments.
On joint request, matter be listed for
compliance/recording of statements qua settlement on
18.10.2023 at 2.00 PM.
