Ashok Kumar Vs. Tulsi Ram
21.04.2026
Present: Sh. Murari Lal Sharma, Ld. Counsel for plaintiff.
Sh. D.N. Pandey, Ld. counsel for the defendant.
Ms. Shruti, Ld. Proxy counsel for Sh. B.S. Chauhan,
Ld. Counsel for the applicant namely Sh. Abdul Saleem
Shah (Under Order 1 Rule 10 CPC).
Today the matter is listed for arguments on application
under Order 1 Rule 10 CPC. However, at this stage, Ld. Proxy
counsel for the applicant seeks adjournment submitting that the main
counsel is not available today as he is out of station to attend a
marriage ceremony of his relative.
Request for adjournment is vehemently opposed by the
Ld. Counsel for plaintiff submitting that the applicant has filed a
frivolous application and has been delaying the matter on one pretext
or another and one the LDOH, last & final opportunity was granted
to the applicant for arguments on his application.
Heard. Perused.
Having perused the record, this court finds merits in the
arguments of the Ld. Counsel for plaintiff that more than desirable
opportunities have already been granted to the applicant to address
arguments on the application and even on LDOH, the matter was
specifically adjourned for the said purpose at the request of the
applicant as part of last indulgence.

of costs quantified at Rs.5,000/-, to be paid to the plaintiff on or
before the next date of hearing.
This indulgence is being extended to ensure that the
matter is decided on merits, however, it is made clear that no further
adjournment shall be granted for this purpose
