Perusal of record shows that on the LDOH, the applicant
(under Order 1 Rule 10 CPC) was granted last and final opportunity
to address arguments subject to the payment of cost of Rs.5,000/-.
However, none is in attendance on behalf of the applicant. Pass over
is also sought on behalf of the plaintiff.
In view of the same, let the matter be passed over for
12:00 P.M. for appearance of the applicant as well as Ld. Counsel for
plaintiff.

At this stage, Ld. counsel for the applicant seeks waiver
of cost which was imposed vide order dated 21.04.2026. It is
submitted by Ld. counsel for the applicant that due to personal

exigency i.e. marriage of his brother-in-law, he was unable to appear
before the court on the said date.
In view of the grounds stated, the cost imposed vide
order dated 21.04.2026 is hereby waived of.
