Fresh suit under Order XXXVII CPC received. It be checked and registered.
Present : Sh. Samir Tandon, Ld. Counsel for the plaintiff.
Heard.
It is submitted by the Ld. Counsel for the plaintiff that the suit
under Order XXXVII CPC was filed before the court of Ld. DJ-04, North
West, Rohini, Delhi, vide order dated 09.08.2024, the plaint was returned
by the Court and therefore, the plaint is refiled as this Court has the
territorial jurisdiction to adjudicate the present matter.
Alongwith the plaint a formal application under Section 151
CPC filed praying that the suit may be listed and heard under the provisions
of order XXXVII CPC for the recovery of Rs. 4,00,000/- being refiled after
return of plaint.
Accordingly the application under Section 151 CPC is
allowed.
It has been submitted by the Ld. Counsel for the plaintiff that
the present suit may be treated as an ordinary suit.
Separate statement of Ld. Counsel for the plaintiff has been
recorded to this effect.
In view of the statement of Ld. Counsel for the plaintiff, the
present suit is treated as an ordinary suit.
Issue summons of the present suit upon the defendant on filing
of PF/RC, for 13.08.2025.
PF be filed within 7 days from today.
The date has been given as per the convenience of Ld. Counsel
for the plaintiff.
