amending the plaint AND order dated 09.05.2025 of Ld. Principal
District and Sessions Judge (HQ.), Tis Hazari Courts, Delhi
transferring the case to this Court after suit for permanent injunction
was amended by plaintiff for seeking partition and possession of 1/3rd
share of property bearing No. 233, Katra Peran, Tilak Bazar, Khari
Baoli, Delhi.
Plaintiff’s suit has been valued @ Rs. 1,50,00,000/- for
purpose of jurisdiction but requisite Court fee Rs. 99,944/- on 1/3rd
share of the property has not been filed for more than a year.
Plaintiff’s suit is therefore rejected under Order VII Rule
11 (c) CPC.
