Present: Ms. Chitra Malhotra, Learned Counsel for plaintiff
through VC along with Associate Ms. Anita in the
Court.
Two applications, first under Order V Rule 20 of CPC
(IA No.2/2026) for service of defendants by way of publication in
newspapers with affidavit and second for change of AR (IA
No.1/2026) with photocopy of Board Resolution were e-filed on
behalf of plaintiff. Hard copies thereof have been placed in judicial
file.
Arguments on both the applications heard.
In view of the reasons stated in the application under
Order V Rule 20 and in view of the report on the summons qua
defendant, received previously, it is clear that defendant cannot be
served through ordinary process. Therefore, the defendant be served
through substituted mode of service by way of publication in the
Hindi newspaper “Veer Arjun” and English newspaper “Statesman”,
having circulation in the vicinity of locality of defendant on filing of
publication charges and PF. On request, process be given
dasti. The
application under order V rule 20 CPC (IA No.2/2026)is accordingly
disposed off.
In view of the reasons stated in the application for
change of AR and in view of the fact that the application is supported
with Board Resolution of plaintiff, Sh. Sachin Varshney, Chief
Manager, Bank of Baroda, is allowed to be substituted as AR of
plaintiff. The application (IA No.I/2026) is accordingly disposed of.
Re-notify for further proceedings on 04.11.2026.
