Present : Sh. Vijay Sehgal, counsel for appellant with
appellant.
None for MCD.
Sh. Alok Pandey, counsel for intervener/caveator.
Sh. Pritish Sabharwal has joined through video
conferencing on behalf of MCD.
This court is prima facie of the opinion that the
caveator Sameer Jain is not a necessary party and was not
entitled to file caveat petition, since his application under Order 1
Rule 10 CPC was dismissed by ATMCD.
Nonetheless, Sh. Pandey has appeared and is
permitted to watch the proceedings as an intervener.
Sh. Sabharwal who is present virtually for some
other case, accepts notice and undertakes to inform the CLO,
MCD about the present petition.
Sh. Sehgal submits that copy has been served upon
the AE and JE on their whatsapp number.
Sh. Sehgal seeks stay of the impugned demolition
order. It is submitted that irreparable loss shall be caused to
appellant, in case, the respondent/MCD is permitted to go ahead
with the demolition.
Till the next date of hearing, the operation of
impugned order shall remain stayed.

within four weeks from today.
