File taken up today on a caveat application under Section 148A CPC filed
by Ld. Counsel Sh. Prashant Sodhi.

Present: Sh. Prashant Sodhi and Sh. Mukund Sharma,Ld. Counsels for
all the caveaters i.e. LR’s of R-1.
It is submitted that vide order dated 07.05.2025, the execution
petition in respect of impugned judgment and decree dated 17.03.2025 was
stayed by Ld. Predecessor of this court. However, a caveat was already
filed by LR’s of R-1 on 16.04.2025, which was not brought to the notic of
the court by the filing branch.
On the last date of hearing, court notice was directed to be
issued to Ld. Counsel for the appellant. The notice has not been recevied
back. However, a printout of whatsapp message sent to Ld. Counsel Sh.
Atul Bandhu representing the appellant by one of the associates of the
counsel for the caveator has been placed on record and it is submitted that
he has been informed about the caveat and today’s date of hearing.
Ld. Counsel Sh. Atul Bandhu was telephonically contacted on
his mobile No. 9811608039 as mentioned in his vakalatnama by the reader
of the court on directions as the VC of the court was not working,
however, he has informed that since the next date of hearing in the matter
is 1.07.2025 and he is not in town, he is unable to appear today.
It is submiitted on behalf of the caveator that though the
execution petition has not been filed till date, still due to grant of ex-parte
stay despite filing of caveat, the caveator have been prejudiced. It is
sumbitted that the appellant/her counsel be directed to supply a copy of the
appeal and documents to Ld. Counsel for LR’s of R-1 either at his Mobile

No. 8800598540 or E-mail ID prashantsodhi@sodhiandsodhi.in so that he
can file the reply and argue the appeal on the next date of hearing and the
matter is not further delayed.
Directions for issuance of notice of appeal toall the
respondents has already been issued vide order dated 07.05.2025, however,
till date, the PF has not been filed. Appellant/his counsel is directed to
supply the copy of the appeal and the entire paperbook to Ld. Counsel
Prashant Sodhi to electronic mode on the mobile no and the e-mail id
mentioned above within 2 weeks from today.
A copy of this order be sent on the whatsapp of Ld. Counsel
Sh. Atul K. Bandhu by the Reader of the court for integration.
Re-notify for date already fixed i.e. 1.06.2025 for service
report and re-considertion of the stay order.
