It is submitted by Ld. Counsel for D-1 to D-3 that
his pending application U/o 8 Rule 1 CPC may be disposed of as
not pressed as details of Will has been supplied by Ld. Counsel
for plaintiff on 30.10.2025 through Whatsapp but Whatsapp
message could been seen and some time may be given for filing
reply to the pending application U/o 39 Rule 1 and 2 CPC and
filing of WS alongwith application seeking condonation of delay.
It is also submitted that in the application it has been
mentioned as U/o 11 Rule 12 and 14 CPC but only one
application has been moved which is under order Rule VIII Rule
1 CPC.
In view of the submission made, the sole pending
application moved by D-1 to D-3 U/o VIII Rule 1 CPC is
dismissed as not pressed at this stage.
Ld. Counsel for plaintiff submits that replication is
not yet filed as written statement of D-1 to D-3 is still pending.

In view of the submissions made, matter is
adjourned for filing of replication, if any, admission/denial of
documents and framing of issues for 11.03.2026.
