The present appeal has been preferred against the
judgment dated 05.08.2024, passed by Ld. JMFC-01, Central,
Tis Hazari Courts, Delhi, convicting the appellant for the
offences under Section 420/120B and Sections 465/468 IPC and
the consequent order of sentence dated 04.04.2025, awarding
sentence, as specified under the said order.
Ld. Counsel for the appellant has submitted that the
present appeal has been filed within the statutory prescribed
period of limitation on 27.04.2025 and the
e-filing receipt in this
regard has been placed on record.
Issue notice of the appeal to the State/respondent.
Ld. Addl. PP for the State accepts notice on behalf
of State/respondent. Copy of present appeal and the application
have been supplied to Ld. Addl. PP for the State.
Arguments heard. Record perused.
For the reasons stated under the appellant’s
application under Section 389 Cr. P.C./Section 430 BNSS,
submissions made by the Ld. Counsel for the appellant and the
grounds under the present appeal, demonstrating a
prima facie
case, the operation of impugned order of sentence is suspended

till the next date of hearing, on the appellant furnishing personal
bond in the sum of Rs. 15,000/- along with one surety in the like
amount to the satisfaction of the Ld. Trial Court/Ld. JMFC/Ld.
Duty JMFC, within a period of seven days from today. Needless
to mention that the appellant is already on bail in the present
case.
In the interest of justice, list for further proceedings
on 08.08.2025.
A copy of this order be given
dasti to Ld Counsel
for the appellant.
A copy of this order be also sent to the Ld. Trial
Court for information purposes.
TCR be requisitioned two days, prior to the next
date of hearing.
