File is taken up today on filing an application seeking
condonation of delay in filing process fee and for fixing the fresh date of
appointment of Bailiff.
Present: Sh. Virendra Singh, Ld. Counsel for DH/applicant.
Heard. Perused.
2. It is stated that vide order dated 15.04.2026, notice of the
execution and warrant of attachment were issued against the JD for the
next date i.e. 16.05.2026 and DH was directed to appear before Ld. ACJ
for appointment of Bailiff on 28.04.2026 but due to personal difficulties,
Ld. Counsel for DH could not file the process fee within time, therefore,
the Bailiff coule not be appointed.
3. In view of the said submisions, the present application (I.A.
No. 1/2026) is allowed. PF be filed within 2 days. DH is also directed to
appear before the court of Ld. ACJ(Central) Tis Hazari Court for
appointment of bailiff on 04.05.2026. Put up on the date already fixed i.e.
16.05.2026.

2. On filing PF, issue warrant of attachment of the movable assets
to the extent of decretal amount against the JD returnable for 16.05.2026.
3. DH is also directed to appear before the court of Ld.
ACJ(Central), Tis Hazari Court for appointment of bailiff on 28.04.2026.
4. Also, issue notice of the execution application to the JD
through speed post/ approved courier as well as electronic mode i.e.
Whats’App/email, returnable on 16.05.2026 to file affidavit of assets. The
steps be taken within 07 working days.
