BKL AGRO FOODS PRIVATE LIMITED Vs. AMARJIT
KUMAR SAH
15.09.2026
Present : Sh. Deepak Jain, Ld. Counsel for the Plaintiff.
Sh. Amit Sinha and Sh. Shambhu Kumar, Ld.
Counsels for the defendant.
Matter is fixed today for disposal of two
applications filed by the parties i.e. one u/o VII rule 14 CPC
moved by the Plaintiff for placing on record the ledger entries
w.e.f. 01.04.2023 till 31.03.2025 and another application u/o VII
Rule 11 CPC moved by the Defendant for rejection of the plaint
on the ground of improper valuation of suit and insufficient court
fees being affixed to the plaint as well as for defective statement
of truth accompanying the plaint.
After addressing the Court to some extent, Ld.
Counsel for the Plaintiff has offered to withdraw his application
due to some technical defects.
Heard.
In view of the statement made at BAR, the
application of the Plaintiff u/o VII rule 14 CPC is dismissed as
not pressed.
So far as the Defendant’s application u/o VII rule 11
CPC is concerned, a defective statement of truth not in
conformity with the Provisions of CPC has its own repercussion,
however, suit cannot be rejected on this short ground alone.
So far as under valuation or affixation of improper
court fees is concerned, Ld. Counsel for the Plaintiff has filed an

application u/s 149 CPC today and its reply has also been filed
on behalf of the Defendant.
It has been stated that deficient court fees is already
placed on record along with replication and this application has
been filed today only to avoid any technical objections to the
filing of additional court fees.
Heard.
Since the defect is curable in nature and same has
already been cured, hence, I do not find any merits in the
defendant’s application u/o VII Rule 11 CPC, however, as prayed
by Ld. Counsel for the Defendant, the Deficient court fee as well
as the statement of truth filed earlier in the proper format are
taken on record subject to payment of cost of Rs. 2,000/- to be
paid by the Ld. Counsel for the Plaintiff to the Ld. Counsel for
Defendant to compensate him for the delay occasioned.
Now to come up for framing of issues as well as for
case management hearing and for payment of cost on
08.10.2026.
