plaintiff.
Sh. Sanjay Aggarwal, Ld counsel for both the
defendants along with defendant No.1 in person.
Matter is today fixed for arguments on the application
u/o 1 Rule 10 (2) and Rule 13 r/w section 151 CPC moved on behalf
of defendant No.2- Abhishek Verma.
Shorn of unnecessary details, the crux of the application
is that as per defendant No.2, he is having no concern with the suit
property and hence present application for deletion of name of
defendant no.2 from the array of parties.
The Court has put a query to the Ld counsel for
defendant No.2 to make a statement in this respect to which he
replied in affirmative for the purpose of making a statement, on the
next date by producing defendant No.2 in person.
It is also submitted by the counsel for plaintiff that a cost
of Rs. 4000/- imposed vide order dated 26.10.2023 has not been paid
by the defendant till date. Ld counsel for defendant is directed to pay
the same on or before next date of hearing.
Accordingly, put up the matter for payment of cost,
recording of statement of defendant No.2 qua deletion of his name
from the array of parties as well as for further proceedings, now on
24.07.2024.
