None has appeared on behalf of the defendant despite
several calls since morning.
Perusal of the record reveals that defendant was served on
05.06.26 and thereafter time was granted to file the written
statement as per provisions of Commercial Courts Act one week
advance to the next date failing with further directions that on
failure to do so, the cost of Rs.10,000/- shall be imposed upon the
defendant.
However, no written staement has been filed on behalf of
the defendant till date. No plausible reson is forthcoming for his
non appearance or for not filing the written statement.

Accordingly, the right of the defendant to file the written
statement stands closed.
Defendant is proceeded ex-parte accordingly.
