Present: Sh. Manish Malhotra and Sh.Neeraj Kumar,
Counsels for the Plaintiff.
Matter is today fixed for filing of tracking report of
courier.
It is stated that original courier receipt has already
ben filed.
Hard copy of affidavit of service alongwith tracking
report of courier and Certificate U/s 63 of BSA has already been
filed on 17.07.2026 (e-filed on 17.07.2026).
As per report, the defendant has been served through
courier vide consignment no.DEL530998983 on 05.06.2026.
No W.S. has been filed till date. Period of 30 days
has already expired, however, the period of 120 days has not
expired yet.
Let the defendant to file W.S. alongwith statement of
truth and affidavit of admission/ denial of documents within the
statutory period from the date of service alongwith appropriate
application for delay condonation with supply of advance copy to
opposite party at least one week before the next date of hearing,
failing which a costs of Rs.10,000/- shall be deposited with
DLSA, Central District.
Subject to receiving the copy of the written
statement, plaintiff to file replication, if any, and affidavit of
admission/denial of documents on or before the next date of
hearing with supply of advance copy thereof.

As prayed, be put up for report of filing of written
statement/replication/affidavit of admission/denial of documents
and for admission/denial, framing of issues and case management
hearing and if the defendant fails to put his appearance or to file
W.S., the plaintiff is at liberty to lead PE on 11.08.2026.
