Present: Appellant in person with counsel Sh. Harsh Verdhan
Sharma.
This is an appeal against the judgment dated
04.03.2025 and order on sentence dated 22.03.2025 vide which
the appellant/convict has been convicted u/s 138 NI Act and
sentenced to simple imprisonment for three months. Since CC
No. 11802/2017, CC No.11803/2017, CC No. 11804/2017,
C.C.No. 11864/2017, C.C. No. 11859/2017 and C.C.
No.11865/2017 are connected matters arising out of same
transaction, the substantive sentence of imprisonment imposed in
all the abovementioned cases shall run concurrent with each
other. Convict is also directed to pay Rs.5,00,000/- (i.e. the
amount of the cheque in question). He is also directed to pay
simple interest at the rate of 9% p.a. on Rs.5,00,000/- from the
date of filing the present complaint (i.e. 18.09.2017) till date of
order dated 04.03.2025 which shall be payable to the
complainant as compensation within 30 days from today, failing
which the convict shall undergo simple imprisonment of three
months in default.
Counsel for appellant/convict submits that an
application seeking suspension of sentence has also been filed
along with present appeal.
Arguments on said application heard.

Keeping in view of the totality of facts and
circumstances, appellant/convict is admitted to bail till disposal
of present appeal on his furnishing personal bond in the sum of
Rs. 20,000/- with one surety in the like amount to the satisfaction
of this Court as well as on deposit of 10 % of the fine amount
within two months from today before the Ld. Trial Court.
The receipt for deposit of fine amount be placed on
record on or before the next date of hearing.
Requisite bail bond and surety bond furnished.
Accepted till the NDOH.
Appellant/convict be released at once till the
NDOH.
Impugned order on judgment and sentence are
stayed till the NDOH.
TCR be summoned for NDOH.
Issue notice of the present appeal to the
respondent/complainant on filing of PF/RC for the NDOH.
To come up for arguments on 27.10.2025.
Copy of this order be given dasti to Ld. Counsel for
appellant and be also sent to Ld. Trial Court.
