Pr: Sh. Vikrant Arora, Ld. counsel for the plaintiff has joined
through video conferencing.
Sh. Kuldeep Mansukhani, Ld. counsel for the defendant
has joined through video conferencing.
The matter is listed for framing of issues and Case
Management Hearing. After perusing the pleadings & documents,
following issues are framed:-
1. Whether the present suit is not maintainable in view of
Section 3(c) of Delhi Rent Control Act, 1958 as averred in
the written statement? (OPD)
2. Whether the plaintiff is entitled to the decree of possession
in respect of the suit property i.e. Shop in suit property no.
11, admeasuring 100 sq. yards, Kishan Ganj Market, New
Delhi-110007 as shown in red colour in the site plan and
also the portion shown in green colour in the site plan as
annexed with the plaint? (OPP)
3. Whether the plaintiff is entitled to the decree of arrears of
rent/damages in the sum of Rs.11,07,500/- as on
28.02.2025 and for the future use as claimed in the plaint?

4. If the issue no. (3) is decided in affirmative, whether the
plaintiff is entitled for the pre-suit period, pendente-lite and
future interest, if so at what rate and for what period?
(OPP)
5. Relief.
No other issues arises or pressed.

Both the parties are directed to file their respective list of
witnesses within two weeks with copies to be exchanged.
Affidavit of evidence would also be filed by the plaintiff within
two weeks with advance copy to the other side.
The evidence shall be recorded in the case through the
Court Commissioner. The Court will appoint the Court
Commissioner and fix the schedule for recording of evidence on
the next date of hearing.
