Present: Sh. Kamal Khurana Advocate along with Sh.
Sandeep Kumar Authorized Representative of the
plaintiff bank.
None for the defendant.
The Authorized Representative/ Manager of the
plaintiff bank submits that he has instructions to seek return of
the present plaint along with documents attached and the
Court Fees under Order 7 Rule 10 CPC with liberty to file
afresh after completing the PreInstitution Mediation
proceedings in terms of provisions of Section 12A of
Commercial Courts Act. In this regard, the statement of Sh.
Sandeep Kumar, Authorized Representative of the plaintiff is
recorded separately.
I have duly considered the request made by the
Authorized Representative of the plaintiff bank in the presence
of his Counsel, in terms of which the original plaint along with
the documents and the Court Fees are directed to be Returned
to the Authorized Representative/ Counsel for the plaintiff, as
per rules, along with attested copy of this order for filing
afresh after completing the PreInstitution Mediation
proceedings in terms of provisions of Section 12A of
Commercial Courts Act.
At this stage, on request of the Ld. Counsel, the
original plaint, original documents and Court Fees be returned

subject to placing on record self attested copies of the same.
File be consigned to Record Room.
