Pursuant to the order passed on the last date of
hearing, cost of Rs.2,000/- has been deposited by the appellant
with DLSA, Central, Tis Hazari Courts, Delhi. Proof of deposit
of said cost has been placed on record.
The present appeal has been preferred against
judgment dated 15.04.2024 of Ld. MM-03, convicting the
appellant for the offence under Sections 279/337/304A IPC and
Section 3/181 of MV Act and the consequent order of sentence
dated 10.01.2025, passed by the Ld. Trial Court, sentencing the
appellant in the manner specified therein.
It is submitted by Ld. Counsel for the appellant that
the present appeal was filed with a delay and that he has moved
an application for condonation of delay in the present case.
Arguments heard. Record perused.
Issue notice of the appeal and the applications,
annexed therewith, to the State/respondent.
Ld. Addl. PP for the State accepts notice on behalf
of State/respondent. Ld. Counsel for the appellant has submitted
that he would supply a copy of present appeal to Ld. Addl. PP for
the State during the course of the day. Let the same be done, as
prayed for.

For the reasons stated under the appellant’s
application under Section 389 Cr.P.C./Section 430 BNSS,
submissions made by the Ld. Counsel for the appellant and the
grounds under the present appeal, demonstrating a
prima facie
case, the operation of impugned order of sentence is suspended
till the next date of hearing, on the appellant furnishing personal
bond in the sum of Rs. 15,000/- along with one surety in the like
amount to the satisfaction of the Ld. Trial Court/Ld. JMFC/Ld.
Duty JMFC, within a period of seven days from today.
In the interest of justice, list for further proceedings
on 10.10.2025.
A copy of this order be given
dasti to Ld Counsel
for the appellant.
A copy of this order be also sent to the Ld. Trial
Court for information purposes.
TCR be requisitioned two days, prior to the next
date of hearing.
